Applicants present in the US for more than 180 days after the expiration of their valid immigration status, or entering unlawfully, may be declared inadmissible. Waivers may be available for some, but not to individuals who enter or attempt to re-enter the United States illegally after being unlawfully present for one or more years. There is a three year bar to re-entry is imposed if the period of unlawful presence prior to departure was between 180 days and one (1) year. A ten year bar will be imposed for unlawful presence greater than one year.
