The spouse or child of an abusive United States citizen or permanent resident may apply for permanent residency through a self petitioning process without the involvement of the abuser. They may be eligible through cancellation of removal or may file to remove the condition on his/her green card.
Adopted, Abused or Abandoned Children
Unmarried children under the age of twenty-one (21) who have been abused, neglected or abandoned may be granted legal permanent residence through Special Immigrant Juvenile Status (SIJS). The juvenile court must find that the child cannot be reunified with either parent due to abuse, neglect, or abandonment and that it would not be in the best interest of the child to be returned to the home country.
