Overtime pay can be a very contentious issue with employers. Finding an employer that wants to pay any of its employees at 150% of their normal pay rate is difficult. While many employers gladly pay workers overtime wages propertly, some employers use underhanded and illegal techniques to avoid paying the fair overtime compensation mandated by the law.
Management workers are not required to be paid overtime. Questions can arise, however, when employees are given management job titles without actual management functions and responsibilities. Real managers are in a supervisory role and have the ability to influence personnel decisions. Employers may not add a manager title to a position that does not have manager functions just to stop paying that position overtime.
Overtime is structured differently in different states. Arizona follows federal overtime guidelines and California follows California overtime guidelines. Workers in both states are entitled to time and a half pay for any time spent working over 40 hours in one work week. In addition, most California workers are entitled to overtime pay for any time spent working over 8 hours in a day, with double-time pay after 12 hours.
