Civil litigation is the primary means for people to recover losses from deceptive, negligent, or fraudulent actions taken against them. Civil litigation is an action taken under common law. Common law is different from criminal law, which refers to actions of the state against individuals who break statutory law (these individuals are referred to as criminals). Actions under common law refer to individuals or parties in dispute with other individuals or parties.

For example, an insurance company may have a contractual obligation to issue benefits to an individual in the event of a flood in the home. If the individual's home were to be flooded, the insurance company would be obligated under common law to pay the negotiated benefits under the provided contract. If the insurance company refused to pay the benefits, the recourse for the policy holder would be civil litigation.
